Worldnet International uses an index-based fuel surcharge that is adjusted monthly. The fuel of the current month is adjusted based on the finalized monthly rate from two months prior per the U.S. Gulf Coast kerosene-type jet fuel spot price reported by the US Energy Information Administration (EIA). Any scheduled change to the fuel surcharge is effective on the first day of the month and is generally published on our website the day prior or the day the changes becomes effective. Fuel surcharges are subject to fluctuation and may change without prior notice; the most current fuel surcharge will always be found on our website.
Fuel applies to all areas of the world that Worldnet International services.

We may use your Automatically Collected Personal Data to analyze, administer, support, improve the use of the Service. We may use data relating to your use of Service, without identifying you, to analyze, administer, support and improve your access to and use of the Services.

- Overview
Worldnet International Couriers Inc., located in New York, and its U.S. subsidiaries (together as, “Worldnet”, “we”, “us”) complies with the EU-U.S. Data Privacy Framework, UK Extension to the EU-U.S. Data Privacy Framework and Swiss-U.S. Data Privacy Framework (“Principles”) as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the United Kingdom and Switzerland to the United States. Worldnet has certified to the Department of Commerce that it adheres to the Data Privacy Framework Principles. If there is any conflict between the terms in this Policy and the Principles, the Principles shall govern. Jurisdiction
The Federal Trade Commission (FTC) has jurisdiction, enforcement, and investigatory authority over Worldnet’s compliance with the Principles.
- Definitions
“Customer” means a prospective, current, or former customer of Worldnet. The term also shall include any affiliate, individual agent, employee, representative, or customer of a Worldnet Customer where Worldnet has obtained his or her Personal Data from such Customer as part of its business relationship with the Customer or when made available to provision communications, logistics and supply chain services.
“Data Subject” means an identified or identifiable natural living person. An identifiable person is one who can be identified, directly or indirectly, by reference to a name, or to one or more factors unique to his or her persons. For Customers residing in Switzerland, a Data Subject also may include a legal entity.
“Employee” means an employee (whether temporary, permanent, part-time, or contract), former employee, independent contractor, or job applicant of Worldnet or any of its affiliates or subsidiaries, who is also a resident of a country within the European Economic Area.
“Europe” or “European” refers to a country in the European Economic Area.
“Personal Data” means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Personal Data does not include data that is de-identified, anonymous, or publicly available. For Switzerland, the term “person” includes both a natural person and a legal entity, regardless of the form of the legal entity.
“Sensitive Data” means Personal Data that discloses a Data Subject’s medical or health condition, race or ethnicity, political, religious or philosophical affiliations or opinions, sexual orientation, or trade union membership.
“Third Party” means any individual or entity that is neither Worldnet nor a Worldnet employee, agent, contractor, or representative.
- 3. Scope
This Policy applies to the processing of personal data that Worldnet receives in the United States concerning Customers and Employees who reside in Europe, the United Kingdom and Switzerland.
Worldnet provides transportation and logistics services.
This Policy does not cover data from which individual persons cannot be identified or situations in which pseudonyms are used. (The use of pseudonyms involves the replacement of names or other identifiers with substitutes so that identification of individual persons is not possible.)
- 4. Responsibilities
Worldnet’s Quality Department will oversee its data privacy program, including compliance with the Data Privacy Framework Principles. We shall review and approve any material changes to this program as necessary. Any questions, concerns, or comments regarding this Policy also may be directed to quality@worldnet-intl.com.
- 5. Certification
Worldnet will renew its DPF certification annually, unless it subsequently determines that it no longer needs such certification or if it employs a different adequacy mechanism.
Prior to the re-certification, Worldnet will conduct an internal audit as part of its Management System to ensure that its attestations and assertions about its treatment of Personal Data are accurate and that the company has appropriately implemented these practices. Specifically, as part of the verification process, Worldnet will undertake the following:
- Review this DPF policy and its publicly posted website privacy policy to ensure that these policies accurately describe the practices regarding the collection of Personal Data.
- Ensure that the publicly posted privacy policy informs Customers of Worldnet’s participation in the DPF program and where to obtain a copy of additional information.
- Ensure that this Policy continues to comply with the Principles.
- Confirm that Customers are made aware of the process for addressing complaints and any independent dispute resolution process.
- Review its processes and procedures for training Employees about Worldnet’s participation in the DPF program and the appropriate handling of Personal Data.
- 6. Processing Personal Data
Worldnet provides transportation and logistics services to our customers, which are predominantly businesses, although individual consumers are not restricted from purchasing such services.
Worldnet collects Personal Data when Customer accounts are opened and updated, services are provided, interacting with our website, log-in to their account, complete surveys, request information from us, or otherwise communicate with us.
Personal information regarding current, former, and prospective employees is collected to perform human resource administration, operate the business, and maintain contact with individuals.
As a general matter, Worldnet collects the following types of Personal Data: contact information, including, a contact person’s name, email address, mailing address, telephone number, mobile/cell number, title, and company name.
Worldnet collects, uses, stores and transmits personal data for lawful and valid business use, retains data for improvement, recordkeeping, audit and compliance purposes, does not disclosure personal data to third parties unless there is a need to know for the purpose of business administration, performing human resource administration, fulfilling our contractual obligations of providing transportation and logistics services or communicating service-related information with those person(s).
- 7. DISCLOSURES ONWARD TRANSFERS OF PERSONAL DATA
Except as otherwise provided herein, Worldnet discloses personal data only to third parties who reasonably need to know such data.
Disclosure via transmission to third parties of non-HR personal data for customers, customer affiliates, vendors or employees may be required in the following examples, but not limited to:
- Facilitating transportation and logistics services
- Post delivery services
- Government reporting
- Internal business operations
Disclosure via transmission to third parties of HR personal data for employees, temporary employees or contractors may be required in the following examples, but not limited to:
- Human resource management
- Payroll and related processing
- Internal business operations
- Government reporting requirements
Worldnet may also disclose Personal Data for other purposes or to other third parties when a data subject has consented to or requested such disclosure.
Worldnet may be forced to disclose an individual’s personal data when compelled by a request made by a recognized public authority or where required to meet legal obligations.
To the extent provided by this Policy and Principles, Worldnet will only disclosure Personal Data to third parties that have given us contractual assurances that they will provide at least the same level of privacy as required by this Policy and Principles, and they will process Personal Data or limited and contracted purposes only. If Worldnet is aware that a third party has disclosed Personal Data in a way contrary to this Policy and or the Principles, we will take steps to prevent such processing. Worldnet complies with the Principles for all onward transfers of Personal Data from the EU, UK and Switzerland, including the onward transfer liability provisions.
- 8. SENSITIVE DATA
Worldnet does not collect Sensitive Data from its Customers.
- 9. DATA INTEGRITY AND SECURITY
Worldnet makes reasonable efforts to maintain the accuracy and integrity of Personal Data and to update it as appropriate. Worldnet has implemented physical and technical safeguards to protect Personal Data from loss, misuse, and unauthorized access, disclosure, alternation, or destruction.
For example, electronically stored Personal Data is stored on a secure network with firewall protection, and access to Worldnet’s electronic information systems requires user authentication via password, Two Factor Authentication (2FA) or similar means. Worldnet also employs access restrictions, limiting the number of employees who have access to Customer Personal Data. Further, Worldnet facilities have physical safeguards, such as access control and monitoring to prevent unwanted physical access.
Despite these precautions, no data security safeguards guarantee 100% security all the time.
- 10. NOTIFICATION
Worldnet notifies Customers about its adherence to the Principles through its publicly posted website privacy policy.
Worldnet notifies Employees about their rights via internal policies, training, and email notifications.
- 11. ACCESSING PERSONAL DATA
Worldnet personnel may access and use Personal Data only if they are authorized to do so and only for the purpose for which they are authorized.
- 12. RIGHTS TO ACCESS, CHANGE OR DELETE PERSONAL DATA
- Right to Access – as a customer of Worldnet services, you have the right to access your data at any time. Data subjects have the right to know what Personal Data about them is included in the databases and to ensure that such Personal Data is accurate and relevant for the purposes for which Worldnet collected the Personal Data. Data Subjects may review their own Personal Data stored in the databases and correct, erase, or block any data that is incorrect, as permitted by applicable law. Upon reasonable request and as required by the Principles, Worldnet allows Customers access to their Personal Data, in order to correct or amend such data where inaccurate.
- Data Retention – Note that personal data is not removed from our systems permanently upon closure of Customer accounts. Worldnet retains transaction and personal data for a minimum of seven (7) years to comply with various recordkeeping and auditing requirements. No maximum period is defined.
- Amendment – Customers may edit their Personal Data by either logging into their account or by contacting Worldnet via email.
- Authentication – Customers who request their Personal Data will be required to authenticate their identity by email, phone, or mail.
- Response Commitment – Worldnet commits to responding and resolving within thirty (30) days all reasonable written requests to view, amend, limit, or delete Personal Data.
- 13. RIGHTS TO LIMIT USE AND DISCLOSURE
Worldnet offers various means to limit the use and disclosure of your Personal Data, which can be found on our website as consent/opt-out indicators, on our email communications as unsubscribe, within our software’s, or as a general request by email.
For a general request by email, to limit the use and/or disclosure regarding your Personal Data as specified in this Policy, Customers should submit a written request to your local Worldnet office or by email to quality@worldnet-intl.com.
- 14. AMENDMENT
This Policy may be amended from time to time, consistent with the Principles and applicable data protection and privacy laws and principles. We will make employees available of changes to this policy either by posting to our intranet, through email, or other means. Customers may access the most updated version of this policy on our website.
- 15. QUESTIONS OR COMPLAINTS

- 16. ENFORCEMENT AND DISPUTE RESOLUTION
In compliance with the Principles, Worldnet commits to resolving complaints about our collection or use of your personal information within thirty (30) days. EU, UK and Swiss individuals with inquiries or complaints regarding our Policy should first contact Worldnet at: quality@worldnet-intl.com.
Worldnet receives or processes human resources data from the European Union for use in the context of the employment relationship under the EU-U.S. DPF and agrees to cooperate with the EU data protection authorities (DPAs) and comply with the advice given by such authorities with respect to this data.
Worldnet receives or processes human resources data from the UK for use in the context of the employment relationship under the UK Extension to the EU-U.S. DPF and agrees to cooperate with the UK Information Commissioner’s Office (UK ICO) and comply with the advice given by the UK ICO with respect to this data.
If an individual has an unresolved complaint or concern that is not addressed timely or to your satisfaction, that individual may contact our U.S. based third party dispute resolution, the International Centre for Dispute Resolution/American Arbitration Association (“ICDR/AAA”). Please contact or visit https://go.adr.org/dpf_irm.html for more information or to file a complaint.
If the dispute involved human resources personal information, or information collected in the context of an employment relationship, we will cooperate with the respective Data Protection Authorities and comply with the advice of such authorities.

Worldnet provides transportation, logistics and related services, primarily serving businesses.
When applying and holding an account to use Worldnet’s services you, as “Client,” agree that these Terms and Conditions shall apply on your behalf and any person or company you authorize to use your account.
When ordering and using Worldnet’s services you, as “Shipper” and/or “Consignee,” agree on your behalf and on behalf of and anyone else with an interest in the Shipment that these Terms and Conditions shall apply.
“Worldnet” means Worldnet International and any wholly owned subsidiary.
“Client” means the person or company that is the account holder.
“Shipper” means the person or company providing the goods to be sent and any person or company placing the Shipment order.
“Consignee” means the person or company receiving the goods.
“Shipment” means all documents or parcels that travel under one waybill, and which may be carried by any means Worldnet chooses, including air, road, or any other carrier or means of carriage.
A “waybill” shall include any Shipment identifier or document produced by Worldnet such as a label, barcode, or waybill as well as any electronic version thereof. Every Shipment is transported on a limited liability basis. If Shipper requires greater protection, then insurance may be arranged at an additional cost.
Changes to our Terms and Conditions
Worldnet may, at any time and at our sole discretion, amend any terms and conditions with notice to you and public posting on our website, to be effective immediately or on the effective date declared in the notice.
Continuing to use your account and our services following any change constitutes your acceptance of these changes.

Differences by Country or Law
Regno Unito
Shipments ordered under a Worldnet United Kingdom account will adhere to the current BIFA Standard Trading Conditions and Limits of Liability where terms and conditions are different from this Terms and Conditions of Service. - Delivery and Undeliverable
Shipments cannot be delivered to Post Office (PO) boxes. Shipments are delivered to the Consignee’s address given by Shipper but not necessarily to the named Consignee personally. Shipments to addresses with a receiving area will be delivered to that area.
Worldnet may notify Consignee of an upcoming delivery or a missed delivery. Consignee may be offered alternative delivery options such as delivery on another day, redirection, or return.
If the Shipment is deemed to be unacceptable as described in Section 4, it has been undervalued for Customs purposes, Consignee cannot be reasonably identified or located, or Consignee refuses delivery, Worldnet shall use reasonable efforts to return the Shipment to Shipper. This shall be at the Client’s cost and expense.
If it is not possible to return the Shipment, it may be released, abandoned, disposed of, or sold without incurring any liability whatsoever by Worldnet to the Shipper or anyone else.
Worldnet shall have the right to destroy any Shipment if Worldnet is prevented by any law or law enforcement agency from returning it in whole or in part to Shipper, as well as any Shipment of Dangerous Goods.
- Inspection
Worldnet has the right to inspect a Shipment without notice for safety, security, Customs, or other regulatory reasons.
Inspections will be conducted using regulatory approved methods or best practices, using technological or physical means. These methods and means may require the Shipment to be opened.
If inspection takes place in a country where notice or consent is required, Worldnet will provide notice or obtain consent from the Client or Shipper, as required.
Any objection to inspection must be declared for each Shipment, to Customer Service, at the time the Shipment order is placed.
- Dangerous Goods
Dangerous Goods must be declared when placing an order with Worldnet’s Customer Service department. Worldnet only accepts certain Dangerous Goods classes on an individual Shipment basis.
Worldnet does not accept the following Dangerous Goods classes: Explosives (1), Flammable solids (4), Toxic Infectious (6), or Radioactive (7).
- Unacceptable Shipments
A Shipment is deemed unacceptable if:
- it contains firearms, ammunition, explosives, explosive devices or test pieces, air guns, replica or imitation firearms; counterfeit goods; cash; bullion (of any precious metal); prohibited animal parts or remains, such as ivory; or illegal goods, such as narcotics or other illegal drugs, or any other prohibited or restricted items
- the Shipper did not declare upon placing the order or does not have the necessary documentation for Shipments classified as hazardous material, dangerous goods, prohibited or restricted articles under ADR (European Road Transport Regulation on dangerous goods) or by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), or other relevant organization (“Dangerous Goods”)
- it contains any other item which Worldnet, in its sole discretion, cannot carry safely or legally
- the address is incorrect or not properly marked
- the Shipment packaging is defective
- Shipper, Consignee, or any other party with a direct or indirect interest in the Shipment is listed on any applicable sanctions lists as a denied or restricted party.
- Customs Clearance and Regulatory Compliance
Worldnet may perform any of the following activities on Shipper’s or Consignee’s behalf to provide services:
- complete any documents, amend product or service codes, and advance any Customs duties, taxes or other regulatory charges required under applicable laws and regulations, as authorized by local law and regulation.
- repack Shipments if packaging is defective for appropriate transport
- act as Shipper’s or Consignee´s true and lawful agent or designate a Customs broker to perform export control and customs clearance.
- redirect the Shipment to Consignee’s Customs broker or other address upon request by any person who Worldnet believes in its reasonable opinion to be authorized. Shipper or Consignee will provide any extra authorization required by applicable law for Worldnet to facilitate clearance of a Shipment.
All activities performed by Worldnet necessary to facilitate transportation may incur charges to the Client.
- Export Controls and Sanctions
Sanctions imposed by the United Nations, European Union, the Office of Foreign Assets Control, and other Nations restrict trade with certain entities, countries, or territories. Sanctions may include arms embargoes and other economic measures such as restrictions on imports and exports.
- It is Worldnet’s policy to comply with applicable international trade laws including relevant export control and sanctions.
- Failure to comply may expose both Worldnet and our Clients to severe criminal and civil penalties, as well as reputational damage.
Worldnet performs Denied Party Screening for Shipments transported within its network.
- The screening is undertaken to ensure Worldnet is compliant with applicable laws and regulations, and not on behalf of clients who remain responsible for their actions.
- Worldnet cannot act as the Exporter for Export Control purposes or apply for export licenses.
- Shipment Charges, Duties, Fees, and Payment
Worldnet Shipment charges are calculated according to the higher of actual or volumetric weight per piece and any piece may be re-weighed and re-measured by Worldnet using calibrated instruments to confirm measures.
Payment of Customs Duties and other charges due are the responsibility of the Client. This includes a fee if Worldnet uses its credit with the Customs authorities or pays any Customs duties on behalf of any of the interested parties to the transaction. Client shall pay Worldnet for all Customs duties and other charges due for services provided by Worldnet or incurred by Worldnet in relation to the transaction.
Worldnet payment terms are thirty (30) days from the date of the invoice for Shipment charges and due on receipt of invoice for Customs Duty and VAT/Taxes, or otherwise indicated on the invoice or allowed by applicable law where the account is established.
Failure to provide payment on time will result in late payment charges, such as fixed charges, interest charges at the current rate, and/or administrative charges.
If the Client Account has a secondary payment method on file (such as a credit card), payment will be applied through the secondary payment method to avoid the initial payment failure.
Outstanding balances after sixty (60) days from the date of the invoice may result in a freeze or closure of the Client’s account, transfer of outstanding balance to a debt collection company and additional recovery charges may apply.
- Worldnet’s Liability
Worldnet’s liability in respect of any Shipment transported within the same country by air or land, is limited to $100 or the local equivalent per Shipment, or the value of the shipment, whichever is less, unless stated otherwise or required by applicable law where the Account is established.
Worldnet’s liability in respect to any Shipment transported internationally by air (including ancillary road transport or stops en route) is limited by the Montreal Convention or the Warsaw Convention as applicable, or in the absence of such Convention, to the lower of (i) the current market or declared value, or (ii) 22 Special Drawing Rights per kilogram (approximately $US 30.00 per kilogram). Such limits shall also apply to all other forms of transportation, except where Shipments are carried only by road, when the limits below apply.
For cross border Shipments transported by road, Worldnet’s liability is or shall be deemed to be limited by the Convention for the International Carriage of Goods by Road (CMR) to the lower of (i) current market value or declared value, or (ii) 8.33 Special Drawing Rights per kilogram (approximately $US 11.00 per kilogram). Such limits will also apply to national road transportation in the absence of any mandatory or lower liability limits in the applicable national transport law.
Worldnet’s liability is strictly limited to direct loss and damage to a Shipment only and to the limits in this section. Where the limits are applicable by weight, the chargeable weight will be used. All other types of loss or damage are expressly excluded (including but not limited to lost profits, income, interest, future business, incidental and consequential damages), whether such loss or damage is special or indirect, and even if the risk of such loss or damage was brought to Worldnet’s attention.
Worldnet will make every reasonable effort to deliver the Shipment according to Worldnet’s regular delivery schedules, but these schedules are not binding and do not form part of the contract. Worldnet is not liable for any damages or losses caused by delay, but for certain Shipments, Shipper may receive a credit from Worldnet not to exceed the service fee charged.
- Claims
All claims must be submitted in writing to Worldnet within five (5) days of the date that Worldnet delivered the Shipment, failing which Worldnet shall have no liability whatsoever. Claims are limited to one claim per Shipment, settlement of which will be full and final settlement for all loss or damage in connection therewith.
- Insurance
Worldnet may be able to arrange insurance for loss of or damage to the Shipment, covering the full or partial declared value of the goods, provided that the Shipper requests insurance from Worldnet’s Customer Service at the time the order is placed.
In no event will insurance cover indirect loss or damage, or loss or damage caused by delays.
- Circumstances Beyond Worldnet’s Control
Worldnet is not liable for any loss or damage arising out of circumstances beyond Worldnet’s control. These include but are not limited to electrical or magnetic damage to, or erasure of, electronic or photographic images, data or recordings; any defect or characteristic related to the nature of the Shipment, even if known to Worldnet; any act or omission by a person not employed or contracted by Worldnet – e.g. Shipper, Consignee, third party, Customs or other government official; third party cyberattacks or other information security related threats; “Force Majeure” – e.g. earthquake, cyclone, storm, flood, fog, war, plane crash, embargo, riot, epidemic, pandemic, civil commotion, or industrial action.
- Shipper’s Representations, Warranties, and Indemnities
Shipper shall indemnify and hold Worldnet and its directors, officers, employees, and agents harmless from and against all and any liabilities, losses and damages arising out of Shipper’s failure to comply with the following warranties and representations:
- the Shipment is acceptable for transport,
- the Shipment was prepared in secure premises by reliable persons and was protected against unauthorized interference during preparation, storage, and any transportation to Worldnet.
- Shipper has complied with applicable export control, sanctions, Customs laws and
regulations or other applicable regulatory requirements and restrictions related to the import, export, transit, value, or transfer of goods.
- Shipper has declared to Worldnet any controlled dual-use or military goods subject to government authorizations contained in the Shipment.
- Shipper has provided all information, permits, licenses or other government
authorizations and documents, as required by applicable law or upon request from
Worldnet, and all information, permits, licenses or other government authorizations and
documents provided by Shipper or its representatives are true, complete, and accurate,
including the value and description of the goods and Shipper and Consignee
information.
- When providing personal data to Worldnet, Shipper has complied with its legal obligations to process and share this data, including informing the affected individuals that personal data, including Consignee’s email address and mobile phone number, is required for communication, transport, Customs clearance, and delivery.
- Routing
Shipper agrees to all routing and diversion, including the possibility that the Shipment may be carried via intermediate stopping places.
- Disputes
Parties s agree to mediate any disputes privately, either by certified or registered mail or electronic communication “email,” within 30 days of occurrence to the satisfactory acknowledgement of both parties. If no resolution can be made, both parties agree that any disputes or claims under this Agreement or its breach shall be submitted to and resolved exclusively by arbitration conducted in accordance with arbitration rules of the country of governing law or international arbitration rules.
Any decision in arbitration shall be final and binding upon the parties. Judgment may be entered thereon in any court of competent jurisdiction, if applicable.
Notwithstanding the above, either Party may sue in any court for infringement of its proprietary or intellectual property rights.
- Governing Law
Any dispute arising under or in any way connected with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of, and governed by the law of the country where the Client’s Account is established, without giving effect to any choice or conflict of law provisions, and all interested parties irrevocably submit to such jurisdiction, unless contrary to applicable law.
- Severability
The invalidity or unenforceability of any provision shall not affect any other part of these Terms and Conditions.
- Termination of Service and Survivability
Either Worldnet or Client may terminate service at any time, for any reason, by giving the other party written notice with sufficient time as allowed by law.
The provisions within these Terms and Conditions which call for performance subsequent to termination of service, shall survive such termination, whether or not such provisions expressly state that they shall survive.

CONDITIONS GENERALES DE VENTE
ARTICLE 1 – OBJET ET DOMAINE D’APPLICATION
Les présentes Conditions Générales de Vente (ci-après « CGV »), ont pour objet de définir les modalités d’exécution et ensemble des Prestations exécutées par Worldnet en France, qui en qualité de commissionnaire de transport et de transporteur organisent et facturent les Prestations.
Les présentes CGV règlent les relations entre le Client et le Commissionnaire de Transport et Transporteur.
Les présentes CGV s’appliquent de plein droit et leurs dispositions priment sur toutes dispositions non expressément acceptées par Worldnet et notamment les conditions générales du Client.
Il ne peut y être dérogé que par écrit.
Worldnet se réserve le droit de modifier les CGV à tout moment. Les nouvelles CGV seront applicables dès lors qu’elles auront été notifiées au Client par tout moyen, à compter de la date stipulée.
ARTICLE 2- DÉFINITIONS
Pour l’interprétation des présentes CGV les définitions suivantes s’appliquent :
Client : le donneur d’ordre, l’expéditeur, la personne physique ou morale, à qui Worldnet fournit des Services selon ces CGV
Commissionnaire de transport ou Worldnet : prestataire de service qui s’engage pour le compte d’un commettant à organiser le déplacement d’une marchandise.
Marchandise : tout bien meuble qui fait l’objet des prestations de transport
Parties : on entend Worldnet, commissionnaire de transport et/ou Transporteur, et le Client
Prise en charge : acceptation, par Worldnet, de la marchandise
Prestation : ensemble des opérations et prestations effectuées par Worldnet consistant au transport de la Marchandise, et prestations afférentes, de toutes natures, de toutes provenances, pour toutes destinations, moyennant un prix librement convenu assurant une juste rémunération des services rendus, tant en régime intérieur qu’en régime international pour le compte du Client
Transporteur : prestataire de service qui s’engage à déplacer la Marchandise
Worldnet : Worldnet International France Limited – 7-11 rue des gazomètres – 93210 La Plaine Saint-Denis
ARTICLE 3- PRIX DE LA PRESTATION
3.1.
Calcul du Prix
Les prix de la Prestation sont calculés sur la base des informations fournies par le donneur d’ordre, en tenant compte notamment des prestations à effectuer, de la nature, du poids, et du volume de la Marchandise à transporter et des itinéraires à emprunter. Worldnet prend en compte deux indicateurs de mesure : le poids réel et le poids volumique. Le plus important des deux sera pris en compte.
Les Prix de la Prestation sont également fonction des conditions et tarifs des sous-traitants éventuels de Worldnet. Si ces derniers venaient à être modifiés de façon opposable à Worldnet, les Prix des Prestations de transport fournis par Worldnet pourraient donc faire l’objet de modifications.
Ces tarifs sont applicables pour toute Prestation réalisée en France et à l’étranger.
3.2.
Modalités de calcul
Les prix ne comprennent pas les droits, taxes, redevances et impôts dus en application de toute règlementation notamment fiscale et douanière.
3.3.
Renégociation
Les prix initialement convenus sont susceptibles d’être renégociés au moins une fois par an. Ils sont aussi révisés en cas de variations significatives des charges du Commissionnaire de transport, charges qui tiennent le plus souvent à des conditions extérieures au Commissionnaire de transport, telles que notamment le prix des carburants.
3.4.
Réductions de prix
Des réductions de prix ne sont pas à proprement parlé appliquées.
Deux types de tarifs peuvent être appliqués, selon que la Prestation correspond à un service « spécial » réalisé le plus souvent dans l’urgence ou à un service de « groupage » pour lequel la Marchandise de plusieurs Clients sont enlevés et traités en même temps.
3.5.
Conditions de règlement
La Prestation est toujours facturée au Client.
Worldnet adresse au Client une facture correspondant à la Prestation et une facture correspondant aux droits et taxes avancés par Worldnet, dans laquelle sont inclus des frais d’avancement..
La facture correspondant à la Prestation et autres frais sont payables au siège de Worldnet à 30 jours maximum date de facturation.
Une facture correspondant à la Prestation est établie conformément aux tarifs applicables augmentée de la TVA applicable au transport
La facture correspondant à la Prestation est adressée, de manière générale, mensuellement, le 30 de chaque mois. La facture correspondant aux droits et taxes avancés par Worldnet, dans laquelle sont inclus des frais d’avancement, est adressée à raison de deux échéances mensuelles et est payable et exigible à 7 jours à compter de sa réception par le Client.
Tout retard de paiement de l’une ou l’autre des factures entraine de plein droit, le jour suivant la date de règlement figurant sur la facture, l’exigibilité d’intérêt de retard d’un montant équivalent au taux d’intérêt appliqué par la Banque Centrale Européenne majoré de dix points et fixé selon les modalités définies à l’article L.441-6 alinéa 12 du Code de commerce et ce sans préjudice de la réparation éventuelle, dans les conditions du droit commun, de tout autre dommage résultant directement de ce retard. La date d’exigibilité du paiement, le taux d’intérêt des pénalités de retard figurent sur la facture.
ARTICLE 4- TRANSPORT DE LA MARCHANDISE
4.1.
Prestation de transport
Worldnet prend en charge la Marchandise au lieu convenu et la livre au lieu convenu entre les Parties, conformément à l’ordre de service établi par Worldnet, envoyé par email au Client.
Worldnet met tout en œuvre pour respecter la période et la date de livraison fixées dans l’ordre de service envoyé par email.
La Marchandise est récupérée par Worldnet ou par ses partenaires en France ou à l’étranger, puis est pesée, mesurée, mise en sac, emballée et sécurisée par Worldnet ou par ses partenaires en France ou à l’étranger pour être déposée par Worldnet ou par ses partenaires en France ou à l’étranger à l’aéroport ou chez le Client.
Toute prise en charge de la Marchandise par Worldnet est accompagnée d’un bordereau de transport.
Le Client est engagé par les instructions figurant sur le bordereau de transport, même si d’autres instructions ont été relayées via informatique/mails ou sous toute autre forme
4.2.
Choix du transport
Worldnet se réserve le droit de décider à tout moment des moyens, itinéraires et procédures les mieux adaptés à chaque étape de prise en charge, manutention, stockage, transport et livraison de la Marchandise, y compris toute modification de moyens, itinéraires ou procédures préalablement convenus
Le transport de la Marchandise peut être terrestre par camions, national ou international, ou aérien, national ou international.
4.3.
Livraison
Le Client est tenu d’inspecter la Marchandise à la livraison et d’avertir Worldnet immédiatement en cas de dommage ou perte apparents, ou de signaler à Worldnet par écrit, dans les cinq (5) jours ouvrés tout dommage ou perte non apparents.
Toute réclamation non effectuée dans le délai ci-dessus indiqué sera jugée tardive et ne pourra entrainer une quelconque responsabilité de Worldnet.
Dans les cas où la Marchandise ne serait pas livrée à la bonne destination, le Client doit en informer Worldnet dès que possible et dans tous les cas dans les vingt-quatre heures à compter de la fin de la date de livraison. Si la Marchandise ne peut être livrée conformément au bordereau de transport en raison de circonstances indépendantes de la volonté de Worldnet, Worldnet en avise le Client ou décharge la Marchandise en entrepôt sécurisé et la conserve. Une seconde livraison sera alors organisée avec le Client. La Responsabilité de Worldnet ne pourra aucunement être recherchée à ce titre.
4.4.
Contrôle des exportations- Formalités douanières
Il appartient au Client de respecter les règlementations nationales et internationales en vigueur en matière de contrôle des exportations y compris les règlementations qui prohibent le commerce non autorisé de certains matériels ou qui imposent le respect de certaines règlementations, notamment les autorisations CITES. Il appartient au Client d’indiquer à Worldnet la nature, la qualité, et la quantité de la Marchandise et si et dans quelles mesures elles sont soumises à autorisation.
La responsabilité de Worldnet ne pourra en aucun cas être engagée en cas de non-respect, par le Client, de ces règlementations nationales et internationales.
Worldnet effectue les formalités douanières de sortie et d’entrée du territoire pour le compte du Client, dans le cadre d’une représentation indirecte avec faculté pour Worldnet de se substituer tout tiers de son choix.
Le Client est dûment informé de ce que les formalités douanières, notamment déclarations en douane, sont effectuées un prestataire exclusif de Worldnet, à savoir la société MTS.
Le Client s’engage à se conformer à toutes les formalités légales, à fournir tout document nécessaire à la bonne exécution des formalités douanières. La responsabilité de Worldnet ne pourra être engagée en cas de retard ou de manquements du fait de l’absence ou de l’inexactitude des documents fournis.
ARTICLE 5- LIMITES ET EXCLUSIONS DE RESPONSABILITÉ EN CAS DE PERTES-AVARIES ET/OU RETARDS
5.1.
En cas de transport terrestre
5.1.1.
En cas de transport terrestre de marchandises en France, les dispositions des articles L.133-1 et suivants du Code de commerce s’appliquent.
Dans tous les cas où la responsabilité de Worldnet serait engagée, pour quelque cause et à quelque titre que ce soit, lors d’un transport terrestre de marchandises en France, la responsabilité de Worldnet serait limitée à 33 euros par kilo sans pouvoir dépasser 1000 euros par colis (si l’envoi est inférieur à 3 tonnes) et 20 euros par kilo sans pouvoir dépasser 3200 euros par tonne expédiée (si l’envoi est supérieur à 3 tonnes) à la condition que la clause ait été connue et acceptée par l’expéditeur lors de la conclusion du contrat de transport et que l’indemnisation n’aboutisse pas à une indemnité dérisoire par rapport au montant du dommage.
Worldnet pourrait être exonéré totalement de sa responsabilité en cas de vice propre de la marchandise, force majeure ou faute du contractant.
5.1.2.
En cas de transport international de marchandises, la CMR s’applique.
Dans tous les cas où la responsabilité de Worldnet serait engagée, pour quelque cause et à quelque titre que ce soit, lors d’un transport international de marchandises, le montant de l’indemnisation, pour perte et avaries, serait limité à la réparation du seul préjudice affectant les marchandises transportées. Cette indemnisation s’opèrerait que la base de la valeur « départ » de la marchandise, avec un maximum fixé à 8,33 DTS par kilo.
Dans tous les cas où la responsabilité de Worldnet serait engagée, pour quelque cause et à quelque titre que ce soit, lors d’un transport international de marchandises, pour retard, le montant de l’indemnisation serait limité au montant du prix du transport.
5.2.
En cas de transport aérien
La convention de Montréal du 28 mai 1999 et la Convention de Varsovie du 12 octobre 1929 (en fonction des conventions en vigueur dans l’état étranger) sont applicables.
Dans tous les cas où la responsabilité de Worldnet serait engagée, pour quelque cause et à quelque titre que ce soit, lors d’un transport aérien de marchandises, le montant de l’indemnisation, en cas de retard, pertes ou avaries serait limité à 16,583 DTS par kilo si la Convention de Varsovie s’applique et à 19 DTS par kilo si la Convention de Montréal s’applique.
Worldnet pourra s’exonérer de sa responsabilité s’il établit avoir pris toutes les mesures nécessaires en vue d’éviter le dommage ou s’être trouvé dans l’impossibilité de les prendre ; s’il prouve la faute de la personne lésée, l’exonération pouvant alors n’être que partielle ; si la perte résulte du vice propre de la chose.
ARTICLE 6- OBLIGATIONS DU CLIENT
6.1.
Le Client est tenu de confirmer :
– la nature, description, quantité et valeur de la Marchandise concernée
– si la Marchandise contient des articles spéciaux ou soumis à restrictions (nocives, inflammables, explosives, dangereuses, périssables…) tel que notamment le transport de matières exotiques soumis à espèces protégées (type crocodiles, python…)
– où et par qui les Marchandises ont été ou seront emballées.
6.2.
Après l’émission du bordereau de transport, le Client est tenu :
– d’avertir WorldNet dès que possible, et dans tous les cas avant la prise en charge de la Marchandise, de toute inexactitude ou insuffisance dans le Bon de livraison, y compris quant aux coordonnées du Client, la date et le lieu de prise en charge de la Marchandise, le lieu de la livraison et les coordonnées du destinataire, le nombre de Marchandises à prendre en charge et tout nombre ou marque spécifique, le poids brut et/ou la quantité de la Marchandise, les instructions requises pour les formalités douanières et autres, et tout autre renseignement ou instruction visant à permettre l’exécution de la Lettre de voiture ;
– fournir à WorldNet les informations et documents dont WorldNet pourrait raisonnablement avoir besoin afin d’exécuter la Prestation ;
ARTICLE 7 – ASSURANCES
Lorsque la valeur de la Marchandise est importante, le Client peut souscrire, par l’intermédiaire de Worldnet, une assurance garantissant la perte et les dommages sur la Marchandise
Le Client est responsable de la souscription d’une assurance adaptée sur une base tous risques pour la totalité de la valeur de la Marchandise. Worldnet peut également le cas échéant proposer au Client une assurance ad valorem qui couvre le vol, la dégradation et la perte sur la Marchandise. Cette prestation supplémentaire sera alors ajoutée sur la facture de transport adressée au Client.
ARTICLE 8- NULLITÉ
Au cas où l’une quelconque des dispositions des CGV serait déclarée nulle ou réputée non écrite, toutes les autres dispositions continueront à s’appliquer.
ARTICLE 9- DURÉE – RÉSILIATION
Les CGV sont applicables pendant toute la durée de la Prestation.
ARTICLE 10- DONNÉES À CARACTÈRE PERSONNEL
La Société recueille des informations à caractère personnel lors de toute signature des conditions générales de vente. Ces données font l’objet d’un traitement dont le responsable est le Directeur de Branche. Ces données sont collectées dans le cadre de l’exécution du contrat et sont nécessaires à la fourniture des services et à l’exécution des obligations contractuelles de la Société. Ces données sont conservées uniquement pour le temps correspondant à la finalité de leur collecte. Worldnet est seul propriétaire des informations recueillies, lesquelles ne seront pas vendues, échangées, transférées, ou données à une autre société à des fins commerciales, sans le consentement exprès du Client. Ces données à caractère personnel ne pourront être divulguées qu’en application d’une loi, d’un règlement ou en vertu d’une décision de justice. Conformément à la réglementation applicable en matière de données à caractère personnel, le Client dispose d’un droit d’accès, de rectification, d’opposition, de limitation du traitement, d’effacement et de portabilité de ses données qu’il peut exercer par courrier au Directeur de Branche, en précisant son nom, prénom, adresse et en joignant une copie recto-verso de sa pièce d’identité.
En cas de difficulté en lien avec la gestion de ses données personnelles, le Client peut adresser une réclamation auprès du délégué à la protection des données personnelles (Directeur de Branche) ou auprès de la CNIL ou de toute autre autorité compétente.
ARTICLE 11- LOI APPLICABLE ET ATTRIBUTION DE JURIDICTION
Les CGV sont régies par le droit français. Tout différend entre Worldnet et le Client sera de la compétence exclusive du Tribunal de commerce de Paris (France) même en cas de pluralité de défendeurs ou d’appels en garantie.

Worldnet International Italia Srl Unipersonale (“Worldnet International Italia”) è una società di diritto italiano, con sede legale e amministrativa in Italia – 20139 – Milano, via Orobia n. 32, Codice fiscale e Partita IVA IT 09880320156 e R.E.A Milano 1327355, soggetta a direzione e coordinamento da parte di Worldnet International Couriers Inc (con sede negli USA).
Il gruppo Worldnet International offre alla propria clientela un’ampia gamma di servizi in grado di assicurare la consegna delle merci in tutto il mondo.
Obiettivo della carta dei servizi
La Carta dei servizi di Worldnet International Italia ha lo scopo di fornire un elenco e una descrizione dettagliata dei servizi erogati e delle tariffe di tali servizi, delle responsabilità di Worldnet International Italia, delle modalità di assistenza offerte ai clienti, delle procedure da seguire per gestire eventuali reclami e dei titoli abilitativi di Worldnet International Italia.
Servizi
I servizi offerti da Worldnet International Italia non rientrano nel Servizio Universale e non sono mai sostitutivi dello stesso. Detti servizi non sono svolti in maniera standardizzata, bensì con modalità operative ed economiche variabili a seconda delle esigenze di volta in volta palesate dalla clientela.
Worldnet International Italia offre le seguenti tipologie di servizi di spedizione:
- EXPRESS: servizio consolidato via aerea o su strada verso destinazioni limitate.
- PREMIUM: servizio dedicato di trasporto aereo Next Flight Out verso destinazioni limitate.
- ON BOARD COURRIER: servizio Hand Carry verso qualsiasi destinazione.
- SPECIALS: servizio dedicato via aerea o su strada verso qualsiasi destinazione.
Le summenzionate tipologie di spedizione prevedono anche servizi a valore aggiunto in ambito di ritiro e consegna a determinati orari o gestione di tipologie di spedizioni (come ad esempio con CARNET ATA, CITES, etc.) e la possibilità di stipulare una copertura assicurativa sul trasporto.
Per l’erogazione di tali servizi, Worldnet International Italia può avvalersi dell’attività/ servizi di fornitori terzi quali società/compagnie di trasporto aereo, su strada, ferroviario, navale o di figure professionali quali dichiaranti doganali e On Board Couriers.
Tariffe
Il prezzo dei servizi di spedizione e dei servizi aggiuntivi è rimesso alla libera contrattazione delle parti. In generale, le tariffe applicate variano in base ad elementi quali la tipologia del servizio, paese di origine e destinazione, peso, dimensioni e numero dei pacchi, costi aggiuntivi per servizi opzionabili/a valore aggiunto.
Il dipartimento Client Solution è responsabile della quotazione di ciascun servizio di spedizione a fronte di una richiesta da parte del cliente; la quotazione viene proposta al cliente per l’accettazione e conseguente conferma del servizio o eventuale rifiuto. La quotazione, tuttavia, potrà prevedere degli importi condizionali o da definirsi durante lo svolgimento del servizio.
Servizio clienti
Worldnet International Italia offre supporto in tutto il processo di spedizione, a partire dal ritiro, al monitoraggio del trasporto fino alla consegna finale. Il Servizio Clienti può essere contattato tramite e-mail all’indirizzo compliance@worldnet-intl.com o telefonando al numero +39 0255213744 dal lunedì al venerdì dalle ore 9.00 alle ore 19.00. Al di fuori di tali orari, l’assistenza clienti di Worldnet International Italia è fornita dall’ufficio di supporto situato a Lancaster reperibile al medesimo indirizzo di posta elettronica.
Reclami
I clienti di Worldnet International Italia possono presentare un reclamo scrivendo all’Ufficio Client Solutions di riferimento, al proprio contatto commerciale o al dipartimento Quality entro cinque (5) giorni dalla data in cui Worldnet ha effettuato la consegna; in caso contrario Worldnet non avrà alcuna responsabilità. I reclami sono limitati ad uno per spedizione, la cui liquidazione sarà completa e definitiva per tutte le perdite o danneggiamenti in relazione ad essa.
Responsabilità di WN INTL
Ai sensi delle leggi che regolano l’assicurazione delle merci trasportate, il vettore è responsabile della perdita e dell’avaria delle merci consegnateli per il trasporto dal momento in cui le riceve a quello in cui le consegna al destinatario.
La responsabilità di Worldnet International Italia in relazione a qualsiasi spedizione trasportata all’interno del territorio nazionale via aerea o su strada è assunta a norma di legge secondo gli articoli 1693, 1694 e 1696 C.C., con conseguente previsione di un limite risarcitorio, in caso di perdita o avaria della merce trasportata, pari al minore tra il valore della spedizione e € 1,00 (uno) per chilogrammo di peso lordo della merce perduta o danneggiata. Tale limite si applica anche in tutti gli altri casi di responsabilità del vettore.
Le responsabilità di Worldnet international Italia in relazione a qualsiasi spedizione trasportata a livello internazionale su strada è limitata dalla Convenzione per il Trasporto Internazionale di Merci su Strada (CMR) al minore tra il valore di mercato corrente o il valore dichiarato, o 8,33 DSP, Diritti Speciali di Prelievo, per chilogrammo lordo trasportato della merce perduta o danneggiata (circa € 10,00 (dieci) per chilogrammo). Tali limiti si applicheranno anche al trasporto nazionale su strada in assenza di limiti di responsabilità obbligatori o inferiori nella legge nazionale applicabile in materia di trasporti.
La responsabilità di Worldnet in relazione a qualsiasi spedizione trasportata a livello internazionale per via aerea (inclusi i trasporti stradali accessori o le soste lungo il percorso) è limitata dalla Convenzione di Montreal o dalla Convenzione di Varsavia, a seconda dei casi, o, in assenza di tale Convenzione, al minore tra il valore corrente di mercato o dichiarato, o fino a 22 Diritti Speciali di Prelievo per chilogrammo (circa € 26,00 chilogrammo). Tali limiti si applicano anche a tutte le altre forme di trasporto, ad eccezione del caso in cui le spedizioni siano trasportate solo su strada, quando si applicano i limiti precedentemente indicati.
La responsabilità di Worldnet è strettamente limitata alla perdita diretta e al danneggiamento di una sola spedizione e ai limiti indicati in questa sezione. Se i limiti sono applicabili in base al peso, si utilizza il peso imponibile. Tutti gli altri tipi di perdite o danni sono espressamente esclusi (inclusi, a titolo esemplificativo ma non esaustivo, perdita di profitti, reddito, interessi, affari futuri, danni incidentali e consequenziali), indipendentemente dal fatto che tali perdite o danni siano speciali o indiretti, e anche se il rischio di tale perdita o danno è stato portato all’attenzione di Worldnet.
Worldnet compirà ogni ragionevole sforzo per consegnare la spedizione secondo i normali programmi di consegna di Worldnet, ma tali programmi non sono vincolanti e non fanno parte del contratto. Worldnet non è responsabile per eventuali danni o perdite causati da ritardi, ma per alcune spedizioni, il mittente può ricevere un credito da Worldnet non superiore alla commissione di servizio addebitata.
Worldnet non è responsabile per eventuali perdite o danni derivanti da circostanze al di fuori del controllo di Worldnet. Questi includono, a titolo esemplificativo ma non esaustivo, danni elettrici o magnetici o cancellazione di immagini, dati o registrazioni elettroniche o fotografiche; qualsiasi difetto o caratteristica relativa alla natura della spedizione, anche se nota a Worldnet; qualsiasi atto o omissione da parte di una persona non impiegata o assunta da Worldnet, ad esempio mittente, destinatario, terza parte, funzionario doganale o altro funzionario governativo; attacchi informatici di terze parti o altre minacce relative alla sicurezza delle informazioni; “Cause di Forza maggiore” – ad esempio terremoto, ciclone, tempesta, inondazione, nebbia, guerra, incidente aereo, embargo, sommossa, epidemia, pandemia, tumulto civile o azione industriale.
Titoli abilitativi
Per l’esecuzione delle proprie attività, Worldnet International Italia possiede i seguenti titoli abilitativi: iscrizione Albo Nazionale degli Autotrasporti di Merci per Conto terzi n. MI/0875104/D e iscrizione nel Registro Elettronico Nazionale REN M0030052.
Worldnet International Italia, nello svolgimento della propria attività sul territorio internazionale e nazionale potrebbe potenzialmente trovarsi ad effettuare il trasporto di plichi o di pacchi sino a trentuno e mezzo (31,5) chilogrammi, rientranti nella normativa dei servizi postali (D. Lgs.261/1999). A tal fine, Worldnet International Italia è titolare di Autorizzazione Generale per servizi postali n. AUG/888/2001.
Worldnet International Italia, nell’ottica del continuo miglioramento aziendale e delle proprie prestazioni e allinearsi al gruppo, ha in programma l’ottenimento della certificazione di Qualità ISO 9001:2015, della certificazione di Sostenibilità ISO 14001:2015, della certificazione di Salute e Sicurezza sul Lavoro ISO 45001:2018.
Trattamento dei dati
Worldnet International Italia gestisce i dati personali acquisiti durante lo svolgimento delle proprie attività nel massimo rispetto delle normative applicabili, in particolare in accordo alla normativa europea GDPR (General Data Protection Regulation) e all’Atto Federale sulla Protezione dei Dati (FADP) emesso dalla Svizzera.
